Terms & Conditions
These terms govern your access to and use of The Trade Kit. By creating an account or using the service, you agree to them.
1. Agreement
These Terms & Conditions ("Terms") are between you and DevCraft House("we", "us") regarding The Trade Kit at https://thetradekit.co.za. If you do not agree, do not use the service.
2. The service
The Trade Kit provides online tools to create quotes and invoices, manage customers and jobs, send documents by email, and related features for trade businesses in South Africa. We may add, change, or remove features from time to time.
3. Accounts
- You must provide accurate registration information and keep it up to date.
- You are responsible for activity under your account and for keeping your password secure.
- You must be at least 18 years old and authorised to bind your business if applicable.
- One person per account unless you use team features and invite authorised users.
4. Acceptable use
You agree not to:
- Use the service for unlawful purposes or to send spam or fraudulent invoices.
- Upload malware, attempt unauthorised access, or interfere with the platform.
- Misrepresent your identity, VAT status, or authorisation to send email from a mailbox.
- Store or process personal information of others without a lawful basis under POPIA.
- Resell or scrape the service except as expressly permitted.
If you configure send-as email, you confirm you own or are authorised to use that mailbox. See our Privacy Policy and POPIA Notice.
5. Your content
You retain ownership of quotes, invoices, customer data, logos, and other content you upload ("Your Content"). You grant us a limited licence to host, process, back up, and transmit Your Content solely to provide the service (including generating PDFs and sending emails you request).
You are responsible for the accuracy of quotes, invoices, VAT amounts, and legal compliance of documents you issue to your customers. The Trade Kit is a tool; we do not provide tax or legal advice.
6. Subscriptions and payment
- Paid plans are billed via PayFast according to the pricing shown at signup or upgrade.
- Fees are quoted in South African Rand unless stated otherwise.
- We may change pricing with reasonable notice; changes apply on renewal unless you cancel.
- Refunds are handled according to our published refund approach and applicable consumer law.
- Free tiers may have usage limits as described on the pricing page.
7. Free tools
Public quote and invoice generators may be used without an account subject to fair use. We may rate-limit or modify free tools at any time.
8. Availability and support
We aim for high availability but do not guarantee uninterrupted access. Maintenance, outages, and third-party failures may occur. Support is provided via support@thetradekit.co.za on a reasonable efforts basis.
9. Intellectual property
The The Trade Kit name, logo, software, and documentation are our property or our licensors'. You may not copy or reverse engineer the service except where law permits.
10. Disclaimer
The service is provided "as is" to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that documents generated meet every SARS or industry-specific requirement — you remain responsible for compliance.
11. Limitation of liability
To the maximum extent permitted by South Africa law, we are not liable for indirect, incidental, special, or consequential damages, or loss of profits, data, or business. Our total liability for any claim relating to the service is limited to the fees you paid us in the twelve months before the claim, or ZAR 1,000 if you use a free plan.
Nothing in these Terms limits liability that cannot be limited by law.
12. Indemnity
You indemnify us against claims arising from Your Content, your misuse of the service, or your breach of these Terms or POPIA in respect of your customers' data.
13. Termination
You may close your account at any time by contacting support. We may suspend or terminate accounts that breach these Terms or pose security or legal risk. On termination, we may delete or retain data as described in our Privacy Policy.
14. Governing law
These Terms are governed by the laws of the Republic of South Africa. Disputes are subject to the exclusive jurisdiction of South African courts, unless mandatory consumer protections require otherwise.
15. Changes
We may update these Terms. We will post the revised version on this page. Material changes may be notified by email or in-app notice. Continued use after the effective date constitutes acceptance where permitted.
